Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.
In these terms and conditions, User or Users means any third party that accesses the Website and is not either (i) employed by Devon Coast Distillery Limited and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to Devon Coast Distillery Limited and accessing the Website in connection with the provision of such services.
You must be at least 18 years of age to use this Website. By using the Website and agreeing to these terms and conditions, you represent and warrant that you are at least 18 years of age.
These terms and conditions will be governed by and interpreted according to English law. All disputes arising under these terms and conditions will be subject to the exclusive jurisdiction of the English courts.
CONTRACT FOR THE SALE AND SUPPLY OF GOODS AND SERVICES
The display of goods on this site is intended to be for the purposes of an invitation to treat only and not as an offer to sell products or services at prices indicated.
No contract for the sale or supply of goods or services will exist between you and Devon Coast Distillery Limited unless or until such time as an email confirmation is sent to you by Devon Coast Distillery Limited stating that your order has been accepted and your payment has been received.
DELIVERY
We are only able to ship items within the United Kingdom.
Unless otherwise specified, all orders for delivery within mainland Great Britain will be dispatched for delivery within 4 working days from the date of order being accepted, excluding weekends and public holidays.
Every effort will be made to ensure that your items arrive with you in perfect condition, in the event that they are damaged or faulty please contact us within 48 hours of receipt by emailing us at [email protected]
RETURNS POLICY
In the event of you having any issues with your order please contact us as soon as possible. We will endeavour to refund the full value of any product(s) purchased if the conditions set out below are met:
You return the product in question to us within 7 days of receipt of your order to the following address:

along with the details of: (i) the reason for return, (ii) the purchaser, (iii) the recipient, and (iv) the order number if purchased online
Unless the item is damaged or faulty, you must return it to us in a resalable condition, unopened and in the same condition that you receive it in
We are unable to refund the cost of postage, either on your original order or the cost of returning the item unless the product itself is faulty
If you have received damaged or faulty items, we will refund the return delivery cost and send a replacement item free of charge or refund the order amount.
We must be notified of damaged or faulty items within 48 hours of receipt of the product, ideally with photographic proof, subject to this, we will refund you within 30 days of your notifying us. In certain situations, the goods may need to be returned for analysis and examination in the event of this being necessary, we will arrange for collection from you by courier.
Should the product show visible signs of damage at the point of delivery such as breakage, damage or leakage, please do not accept the package and request that the carrier returns the goods to us.
If the product is damaged when the courier arrives at your door, and shows clear signs of breakage or leakage at the time of delivery, please refuse the parcel and ask the courier to return the goods to us. Please notify us by email at [email protected] that your order has been returned along with your contact details so that we can investigate and replace or refund as appropriate.
Please note that any reimbursements can only be made or refunded to the credit or debit card used to purchase the original item(s), subject to them being purchased in the United Kingdom.
OUR LIABILITY
The material displayed on our Site is provided “as is” and without any guarantees, conditions or warranties as to its accuracy, to the extent permitted by law, we hereby expressly exclude and disclaim:

Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our Site or in connection with the User Services, or your use of our Site, any websites linked to it and any materials posted on it, including, without limitation any liability for: loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, loss of goodwill, wasted management or office time, and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
Because some jurisdictions do not allow the exclusion or limitation of liability or damages, our liability in such jurisdictions shall be limited to the fullest extent permitted by law.

INDEMNITY
You will indemnify Devon Coast Distillery Limited against any loss, damage or cost incurred by us arising out of your use of our Site, any User Services provided by you or accessible to you via the Site, any breach of these terms and conditions by you, or your violation of any other laws, regulations and rules. You will also indemnify us against any claims that information or material which you have submitted to us is in violation of any law or in breach of any third-party rights (including, but not limited to, claims in respect of defamation, invasion of privacy, breach of confidence and infringement of any intellectual property right). We reserve the right exclusively to defend and control any claims arising from the above and you will fully cooperate with us in any such defences.
